Page 38 <br />Construction Materials Rule 1 <br />and clay operations), the Operator may include in the permit application, <br />amendment or technical Yevision, the information otherwise required when <br />filing a Notice of Temporary Cessation. if approved by the Board or Office, <br />such Notice in the pemut shall serve as a substitute for the Notice of <br />Temporary Cessation as described under Pazagraph 1.13.5(2) with the <br />following conditions: <br />(a) The Operator must report to the Board through the. <br />Annual Report: <br />(i) the condition of the operation at the time of. <br />cessation; <br />(ii) what specific measures have been and will be <br />.implemented to comply -with reclamation and performance <br />standazds and <br />(iii) plans for resumption of mining., <br />(2) The Boazd shall, when necessary, establish the commencement <br />of Temporary Cessation to determine the start of the five (5) year period <br />described in Subsection 1.13.8. <br />to3(it)(c) 1.13.8 Five Year Term of Temporary Cessation <br />A permit granted pursuant to these Rules shall continue in effect as long as: <br />(a) the mining operation is resumed within five (5) years of <br />the beginning of Temporary Cessation; or <br />(b)_ the Operator files a report requesting an extension of the <br />period of Temporary Cessation with the Board stating the reasons for <br />the continuation and those factors necessary to, and the plans for, <br />resumption. <br />1.13.9 Ten Year Limitation for Temporary Cessation <br />
