Page 23 <br />Construction Materials Rule 1 <br />(c) mailing list, newspaper release, and posting as <br />prescribed in Subsubparagraph 2.2.1(a)(iii).' <br />1.6.2 General Applicant Procedures <br />(1) The Applicant shall: <br />(a) Prior to filing the application with.the Office, send a <br />1tz(tj(a) ~ notice, on a form approved by the Boazd, to the-local Boazd of County <br />Commissioners and, If the mining operation is within the boundazies <br />of a soil conservation district, to the Board of Supervisors of the soil <br />conservation district. <br />(i) The Applicant shall include proof of such <br />mailings with the application at the time the application is filed <br />with the Office. <br />(ii) Proof of notice shall be in the form of a return <br />receipt of a Certified mailing or adate-stamped copy of the <br />notice acknowledging receipt by the appropriate local Board. <br />(b) Prior to filing the application, post notices (signs) at the <br />location of the proposed mine site, as required by the Office, of <br />sufficient size and number to cleazly identify the site as the location of <br />a proposed mining operation giving name, address, and phone number <br />of the Applicant, and stating that (name of Applicant) has applied for <br />a mining permit with the Colorado Mined Land Reclamation Boazd: <br />Anyone wishing to comment on the application may view [he <br />application at the County Clerk's or Recordei s office and should send <br />comments prior to the end of the public comment period to the <br />Colorado Mined Land Reclamation Office, and state the Office's <br />address, as given on the cover of these Rules. Any class of Limited <br />Impact 110 or Special 111 Operation need only post notice at the <br />location of the proposed access to the site. After having posted such <br />notice, failure by an Applicant to.maintain such notice (sign) shall not <br />constitute }ust cause to deny approval of the application.
