Pagel l <br />Construction Materials Rule 1 <br />Any person who intends to extract construction materials on federal lands shall <br />apply for a Mined Land Reclamation Board permit unless specifically <br />exempted by the Boazd according to the provisions of this Subsection 1.2. <br />1.3 PUBLIC INSPECTION OF DOCUMENTS <br />(1) Except as provided in Pazagraph 1.3(3) all applications, public <br />notices, inspection reports, documents, maps, exhibits, correspondence, tests, <br />analyses, records of actions or findings of the Boazd or Office and other <br />information required under this law or these Rules shall be promptly made <br />available for inspection to any member of the public at the offices of the <br />Office, during its normal business hours. <br />(2) Upon request, copies shall be provided at cost or other suitable <br />arrangements made for copying at the requester's expense, as allowed by <br />copyright law. <br />tt2(9) (3) An Operator may. mark "CONFIDENTIAL" information <br />sugplied in a germit application disclosing the location, size, or nature of the <br />:deposit or depth and thickness of the deposit and thickness and type of <br />overburden to be removed. <br />(a) Confidential information so maiked shall not be . <br />available to the public until the mining operation is ternunated, unless <br />the Operator gives a written consent on company letterhead and signed <br />by an authorized agent of the company to release all or any part of the <br />information. <br />(b) All information in a Notice of Intent to Conduct <br />Exploration shall be treated as confidential. Such information shall not <br />be available to the public until a finding by the Board-that reclamation <br />is satisfactory, unless the Operator gives a.written consent to the release <br />of all or any part of the information. <br />(c) Anyone who willfully and knowingly violates the <br />provisions of confidentiality shall be putiished as provided bylaw. <br />
