Preston, Greg E. Walther <br />Ezeculive Director <br />Petition for Reconsideration from David B. Wuchert, Michael B. Lang <br />Line Camp Pit, Permit No. M-2001-001 Division Dneclor <br />As staff to the Colorado Mined Land Reclamation Board, the Division has received two petitions <br />for reconsideration of the Board's decision to approve the Line Camp Pit application, over <br />objections. The petitions for reconsideration were submitted on behalf of the Akin/Stepe <br />objecting party, by their attorney James E. Preston, and by objecting party David B. Wuchert. <br />Both of the petitions were submitted in a timely manner. <br />Pursuant to Construction Materials Rule 2.9.3 and 2.9.4, the petitions will be presented to the <br />Colorado Mined Land Reclamation Board as two separate agenda items during the August 22-23, <br />2001 ,Board meeting. Construction Materials Rule 2.9.3 and 2.9.4 states: <br />2.9.3 Consideration of Petition <br />The Board may grant or deny the petition based solely on the written submittal, or the <br />Board may, in its discretion, grant the Petitioner an opportunity to present oral arguments. <br />2.9.4 Automatic Denial of Petition <br />The petition shall be deemed denied unless it is granted within sixty (60) days of receipt of <br />the petition. <br />The August 22-23, 2001 Board meeting will occur in Room 318 of 1313 Sherman Street, Denver, <br />Colorado, beginning at 10:00 a.m., or as soon thereafter as the matters can be considered. <br />Should the Board decide to partially or fully grant either or both of the petitions to reconsider the <br />approval decision, the Board will schedule a hearing for the issues on which the Board has granted <br />reconsideration. <br />Please contact me at the DMG Durango Office, 701 Camino del Rio, Room 125, Durango, CO <br />81301, phone (970) 247-5469, if you have any questions. <br />Si~~e~ j <br />Wallace H.
