SUNDAY, AUG. 30, 1987 <br />SCAR ° on the mountain <br />Quandary <br />of quarries <br />here to stay <br />By Berry Noreen <br />Gazette Telegraph <br />Quarries routinely result in <br />controversy in Colorado, where <br />mining companies need not con- <br />siderthe visual impact of their <br />work. <br />The Castle Concrete Co. <br />quarries near Colorado Springs <br />are among the best-known in <br />the state because of their high <br />visibility. They also have left <br />their mark on state law books, <br />with aprecedent-setting ruling <br />in 1973 from the Colorado Su- <br />preme Court. <br />In that case, the court ruled <br />that Castle's right to mine lime- <br />stone could not be blocked by <br />widespread.concerns about the <br />scars resulting from the work. <br />Few substantive changes <br />have been made in the U.S. <br />Mining Act of 1872, and local <br />zoning in Colorado has seldom <br />served as an obstacle to quar- <br />ries. <br />In Boulder County in 1980, <br />residents succeeded in stopping <br />a quarry by persuading county <br />commissioners that repeated <br />dynamite blasting would dam- <br />age homes nearby. <br />Other than by citing health <br />or safety reasons, though, <br />counties are relatively power- <br />less to stop controversial quar- <br />ries as long as the companies <br />~~~ ;.. r; f ~~ y~V J -s.. <br />5 yr. s 'r r • c, <br />.. The company Colorado Springs over the last 32 years. <br />have mining permits and the <br />proper zoning. <br />This year, Boulderites tried <br />to stop another quarry in <br />nearby Eldorado Canyon.
