Deaz Mr. Mitchell: The Division of Minerals and Geology (DMG) received your letter on December 8, 1997, in which you expressed your concern that the proposed dischazge of waste water from the Bowie No. 2 Mine might adversely affect your health and livelihood. Because your letter describes possible future problems, the DMG does not have sufficient basis to believe that a violation of our regulations has occurred at this time. Therefore, the DMG will not be conducting a field inspection based on your letter. However, the DMG will initiate a review of your situation in order to determine if anything can be done, within our jurisdiction, to alleviate any problems that may arise in the future. Also, since the DMG conducts mine site inspections on a regular basis, the opportunity to meet in the field with you to discuss your concerns, as we have done in the past, is possible. On November 19, 1997, the DMG met with you, Lee Bradley of Bowie Resources and Keith Lucy of the Delta County Health Department at the Bowie No. 2 Mine and the Terror Creek Loadout, in order to discuss the situation involving the Deer Trail Ditch and pond discharge from the Bowie No. 2 Mine. According to my information, an accord was eventually reached whereby Bowie Resources agreed to construct a new segment of the Deer Trail Ditch that flows across the Terror Creek Loadout land, parallel and just to the west of the existing segment. According to the consultant for the Tetror Creek Loadout, Bowie Resources would maintain that segment of the ditch. At the present time, the Bowie No. 2 Mine has a Colorado Department of Public Health and Environment (CDPHE) permit to discharge mine site surface runoff water from their sedimentation ponds. The DMG understands that Bowie No. 2 has applied to the CDPHE for a revision to their discharge permit, in order to discharge underground mine water and the treated effluent from a sewage treatment plant out of their ponds as well. The CDPHE, and specifically the Wa[er Quali[y Control Division (WQCD), is the state agency which has jurisdiction over water quality at point source discharge locations.
