The application is a legal document, as such, this <br />office requires an original application with an original signature. Please resubmit the <br />original permit application back to this office. <br />The total surface area of the groundwater exposed after December 31, 1980 must not <br />exceed 2.7 acres, and uses must not exceed 6.72 acre-feet of evaporative loss, 5.89 <br />acre-feet of water lost in the product, and 2.0 acre-feet used for dust control. Should 'the <br />total consumption at the pit exceed this amount prior to the expiration date of this plan, <br />an amendment will need to be filed with this office. <br />3. Adequate accounting of diversions and replacements must be provided to the Division <br />Engineer in Greeley and Water Commissioner (Mr. Shawn Hoff, 2224 E. County Rd.:?'6, <br />Ft. Collins, CO 80528, phone # (970) 226-3303) on a monthly basis or other interval <br />acceptable to both of them on a form acceptable to both of them. <br />4. The replacement water which is the subject of this plan cannot be sold or lease to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, <br />the replacement water must be appurtenant to this site until a plan for augmentation is <br />obtained. All documents which make the replacement water appurtenant to this site <br />should be recorded with the county clerk and must be submitted to this office. The <br />existing lease for replacement water is in accordance with the letter dated February 27, <br />1998 from Beth Molenaar (City of Ft. Collins) to Mr. Kehn. <br />Approval of this plan is for the purpose as stated herein. Any additional uses for which <br />the water may be used must first be approved by this office. The historic consumptive <br />use credit from natural vegetation stated herein to offset gross evaporation was based <br />on the assumption that the consumption was from precipitation. Any future additional <br />historic consumptive use credit given (e.g. agricultural water transfer) for this site must <br />consider all previous credits given. <br />6. The name, address, and phone number of a contact person who will be responsible fix <br />the operation and accounting of this plan must be provided to the Division Engineer and <br />Water Commissioner. <br />An application far a change in water rights and plan for augmentation must be filed with <br />the Division 1 Water Court within three (3} years of the date mining is completed in such <br />operations unless specific reasons warrant an extension. Renewal of this plan may <br />depend on progress made toward a permanent plan. Approval of this plan does not <br />imply approval by this office of any related litigation. <br />8. In accordance with amendments to 35-8-202(7), C.R.S., and Senate Bill 89-181 Rules <br />and Regulations adopted on February 4, 1992, the state Engineer shall determine if the <br />substitute supply is of a quality to meet requirements of use to senior appropriators. As <br />such, water quality data or analysis may be requested at any time to determine if the <br />water quality is appropriate for downstream water users. <br />This plan shall be valid through April 30, 2000, unless otherwise revoked or modified. <br />Should a request for renewal of this plan be needed, such renewal request must be <br />submitted to this office at least 45 days prior to the expiration date of this plan. <br />
