Proposed Decision RN-3 <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations the <br />application for Permit Renewal No. 3 to conduct surface coal mining operations at the Seneca II- <br />W Mine. <br />The application was submitted by Seneca Coal Company. This decision is based on a fording <br />that the operations will comply with all requirements of the Colorado State Program as found in <br />the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br />Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within <br />thirty (30) days of the first publication of the issuance of this proposed decision, then this <br />decision becomes final. Upon submittal of acceptable surety by the applicant, the permit will be <br />issued. The permit application, all supporting documentation and any stipulations or conditions <br />will become a binding part of the permit. <br />Stipulation attached to Permit Renewal No. 3 <br />Stipulation 28: Bacl~lling and grading of the D pit shall commence by November 15, <br />2001, unless SCC files a complete application in accordance with the <br />requirements of Rule 2.06.7, Variances for Delay in Contemporaneous <br />Reclamation Requirements in Combined Surface and Underground <br />Mining Operations. <br />Stipulation attached to Minor Revision 42- July 29. 1997 Continues in effect: <br />Stipulation 24: Proof of resolution of Kentucky Civil Penalty Violation and bond <br />forfeiture associated with Permit Number 8980140 shall be submitted to <br />DMG as soon as it becomes available. <br />Progosed Decision PR-3 <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations the <br />application for Permit Revision No. 3 to revise surface coat mining operations at the <br />Seneca II-W Mine. <br />The application was submitted by Seneca Coal Company.
