The <br />Zoning Administrator has agreed to restate our position regarding the use on your property, and to <br />provide further clarification on that position: <br />1. The milling of ore imported to the site, regardless of ownership, constitutes an industrial use, and is <br />therefore not allowed in the Forestry District. <br />2. In the definition of Mining Operation found in Section 28-259 of the Boulder County Zoning <br />Resolution, it states that "The term includes the following operations on affected lands: Transportation, <br />concentrating, milling, evaporation, and other processing." A copy of this section is enclosed. <br />3. In the definition cited above, the term "affected lands" refers to lands that are affected by minin¢. <br />The milling of ore is a use that is accessory to the principal use of mining. Importation of ore means <br />transporting ore from locations outside the affected lands to the mill. <br />4. Only ore from within the affected lands may be processed at the Gold Hill Mill. Affected lands for <br />the Gold Hill Mill are those claims and mine dumps that were represented to tite County as sources for <br />the mill at the time the permit was issued for the mill. Please remember also that you may not mill ore <br />that you do not own. <br />5. We aze requiring that the importation of ore from locations outside the affected lands for the Gold <br />Hill Mill discontinue immediately. To verify compliance in this regard, we are requiring that you <br />provide copies of all documents submitted to the Division of Minerals and Geology that disclose the <br />location of the sources of all ore to be processed at the Gold Hill Mill. 'This includes any quantity for <br />any purpose. To ensure that this information is provided in a timely manner, we are requiring that you <br />provide this documentation by the loth of each month for the preceding calendar month. This means that <br />by September 10, 1994, you must submit copies of documents for ore requested to be milled on the <br />property that were submitted to the Division of Minerals and Geology during the month of August 1994. <br />Such documentation will be required each month by the 10th. <br />Sandy Hume Ronald K.
