COLORADO 80226 December 3, 1982 Re: Schwartzwalder Mine - File No. 77-300 Dear Mr. Shelton: This letter is responsive to the Division November 29, 1982 letter to Cotter, and is ordered to coincide with the issues addressed in the November 29 letter. 1. Cotter will file, prior to the February 24-25, 1983 MLRB meeting, an amendment application including, among other matters proposed, solutions to the problems of: the potential instability of the current waste pile; the size and location of, and the cutoff grade for uranium content to be placed in, the waste pile; and the borrow area adjacent to Ralston Creek. 2. The following preliminary outline of the amendment application to be filed in February, 1983, addresses each section of the existing permit which will be updated or amended to reflect current and anticipated conditions at the mine site. The preliminary maps for the mining and reclamation plans will be transmitted to the Division under separate cover prior to December 15, 1982. a. The section 112 Permit Application Fornl will be updated to reflect changes in Cotter's address, ownership of the mine site, number of acres of affected land, and zelated information. b. Exhibit A - Legal Description - The description of the acres of affected land will be updated to include the following: the change in the size of temporary waste pile; the change in designation of that pile from temporary to permanent; the inclusion of those areas to be affectec. by mining activities for the remaining life of the mine; and a clarification of the reasons for an error in the original estimate of affected land, including areas which pre-existed the original filing date of the permit application, i.e., the borrow area.
