-16- <br />Information supporting these conclusions can be found in vclume 1, paces <br />97-115, 17-18. <br />XIV. Miscellaneous Compliance (2.05.6(5), 4.02, 4.12, 4.19, 5.21, 4.?8, 6.30) <br />The miscellaneous compliance sections of the pen:.it application have been <br />reviewed by the Division. The proposed operation is in compliance. <br />X'd. Operations on Lands Subiect to :.imitations or Prohibitions (2.03.1, 2.10) <br />The proposed operations is in compliance with the requirements of these sections <br />and 2.07.6(2)(d) for the followinc reasons: <br />1. The permit area of the proposed operation is not within: <br />a. Rn area designated unsuitable for mining; <br />b. An area under study for designation as unsuitable for surface <br />coal mining; <br />c. On any lands subject to prohibitions or limitations, and <br />d. Within 300 feet of an occupied dwelling. <br />XVI. Demonstration That Surface Coal Mining and Reclamation Operations Can <br />Be Feasibly Accomplished (2.07,6(2)(b) <br />Based on information contained in the application, the Division finds that <br />surface coal mining and reclamation can be feasibly accomplished. Information <br />demonstrating the feasibility of the operation and reclamation plan can be <br />found in Volume 1, pages 97-115, 116-129. The proposed operation is in <br />compliance. <br />XVII. Comparability With Anticipated Adjacent Operations (2.07.6(2)(1)) <br />Coors Energy Company's proposed operations is not inconsistent with Other <br />operations anticipated to be performed in adjacent areas. Information <br />demonstrating computability can be found ir. Volume 1, panes 18 and 20'. <br />XVIX. Reclamation Fees Reouired by 30 CFR Chapter VII, Subchapter R (2.07.6 <br />(27 lo) ) <br />To date, Coors Enerav Company has not extracted any coal from the Keenesburc <br />mine site or any other mine site. Therefore, no reclamati on fees are currently <br />due, However, the applicant should be aware of this zecuirement. The <br />proposed operation is in compliance. <br />
