based on AVS check conducted at that time. Stipulation compliance was documented based on <br />AVS checks conducted in association with Permit Revision No. 3, issued May 1, 2003. The <br />stipulation has been resolved and terminated. <br />Stipulation 28 originated with RN-3 Renewal Permit. The stipulation required that backfilling and <br />grading of the D pit commence by November 15, 2001. The Division documented compliance <br />during an inspection conducted on November 14, 2001. Statements in the inspection report indicate <br />that backfilling and grading operations had been initiated that day and that a dozer was working at <br />the east end of the D Pit, pushing spoil into the pit. D Pit backfilling and grading was largely <br />completed by the end of 2002. The stipulation has been resolved and terminated. <br />Stipulation 29 was attached to the MR-51 approval decision, issued March 21, 2002. The revision <br />was a field minor revision decision approving minor modification of the temporary stabilization <br />seedmix. The stipulation required submittal of 3 copies of the amended seedmix by April 18, <br />2002. The properly updated pages were received on April 19, 2002. The stipulation has been <br />resolved and terminated. <br />Stipulation 30 was attached to the PR-3 proposed decision, issued May 1, 2003. The stipulation <br />required sample based demonstration of soil strength properties for foundation and construction <br />soils associated with Pond 016A, prior to initiation of pond construction. Adequate site specific <br />soil strength documentation was submitted to the Division in a letter of June 20, 2003. The <br />Division notified SCC that Stipulation 30 had been satisfied, in a letter of July 3, 2003. The <br />stipulation has been resolved and terminated. <br />Stipulation 31 was attached to the TR~2 proposed decision, issued 10/14/03. The stipulation <br />required submittal of a complete revision application containing an appropriately amended Exhibit <br />13-2A, accurately depicting the location of specified light use roads by November 28, 2003. The <br />stipulation was satisfied by submittal of TR~15, which was deemed complete on December 1, 2003. <br />The stipulation has been resolved and terminated. <br />Stipulation 32 was attached to the TR-42 proposed decision, issued 10/14/03. This stipulation <br />remains in effect (see above. <br />Stipulation 33 was attached to the TR-42 proposed decision, issued 10/14/03. The stipulation <br />required submittal of a complete revision application containing a relevant showing statement in lieu <br />of certification for the Coal Carrier's Access Road. The stipulation was satisfied by submittal of <br />TR-45, which was deemed complete on December 1, 2003. The stipulation has been resolved <br />and terminated. <br />Stipulation 34 was attached to the PRA proposed decision, issued November 17, 2004. The <br />stipulation required submittal of amended, properly certified map Exhibits 3-1, 3-2, 3-3, and 3-4. <br />The stipulation was satisfied by submittal of TR-51, deemed complete on March 3, 2005.
