<br />SPECIAL STIPULATIONS <br />• COC-58780 <br />1. Yearly production figures shall be reported during January of each year. <br />2. The permittee shall comply with the applicable Federal and State laws and regulations <br />concerning the use of pesticides (i.e., insecticides, herbicides, fungicides, rodenticides, and <br />other similar substances) in all activities and/or operations under this free use permit. The <br />permittee shall obtain from the authorized officer approval of a written plan prior to the use <br />of such substances. The plan must provide for the type and quantity of material to be used; <br />the pest, insect, fungus, etc., to be controlled; the method of application; the location for <br />storage and disposal of containers; and other pertinent information that the authorized officer <br />may require. The plan should be submitted no later than six weeks prior to the proposed <br />activities. <br />If need for emergency use of pesticides is identified, the use must be approved by the <br />authorized officer. The use of substances on or near the permit area shall be in accordance <br />with its registered uses and without other limitations if the Secretary of the Interior has not <br />imposed restrictions. A pesticide shall not be used if the Secretary has prohibited its use. <br />Pesticides shall not be permanently stored on Federal lands authorized for use under this <br />permit. <br />3. Permittee is responsible for all suppression costs for any fire resulting from their operations <br />and practices. <br />4. Permittee is responsible for disposing of all debris in accordance with state and federal <br />regulations. Permittee is responsible for keeping the material site free of all litter and trash. <br />5. If paleontological or cultural resources are encountered, the operator will immediately cease <br />operations and notify the Uncompahgre Basin Resource Area Manager. The permittee shall <br />not remove, injure, deface or alter any object of scenic, historic or scientific interest, <br />including Indian ruins, pictographs and other archaeological remains. <br />6. The top four to eighteen (4-18) inches of topsoil shall be removed and stockpiled for later <br />use in pit rerlamation. The stockpile shall be stacked in an area where it will nct be <br />disturbed until used for pit reclamation. This stockpiled material shall be stabilized with the <br />seed mix described below. <br />7. Between operations, the pit wall shall be maintained at a slope ratio not to exceed 2:1 so <br />as to minimize slope failure potential and public safety hazards. <br />8. Pit rehabilitation shall consist of, but not be limited to, the following requirements: <br />a. The Uncompahgre Basin Resource Area Office shall be contacted five (5) days prior <br />to the commencement of reclamation. <br />b. All rejected oversized material will be buried in the excavation prior to rehabilitation. <br />c. The pit walls shall be sloped to existing contours not to exceed 2:1 and compatible <br />with the surrounding landforms. <br />
