BANTA, Director <br />January 19, 1988 <br />Mr. Robert Hagen <br />Director, Albuquerque Field Office <br />625 Silver Avenue, S.W, <br />Albuquerque, New Mexico 87102 <br />Re: GEC Minerals, Legal Action <br />Dear Mr. Hagen: <br />Enclosed please find a copy of the legal action brought against GEC Minerals <br />on behalf of the State of Colorado. This action should be sufficient for <br />OSMRE's vacation or withdrawal of the outstanding federal violations. <br />The Division is of the opinion that the violations must be either vacated or <br />withdrawn. The Division responded appropriately to the TDN and by forfeiting <br />the bonds and completing OSMRE's interpretation of alternative enforcement. <br />Termination of the violations would not be appropriate since the violations <br />have not been abated and we are in the alternative enforcement mode. <br />Violations can only be terminated when all steps necessary for abatement have <br />been completed. <br />In addition, there would still be an issue outstanding concernin <br />penalties. It would be counterproductive at this time for OSMRE <br />civil penalties when the state is taking legal action to resolve <br />and existing financial resources may be limited.
