The mine is <br />operated by Oxbow Carbon and Minerals Inc. <br />I am requesting this inspection because of the conditions <br />described below which i believe result in a violation of the <br />following requirement of the law: <br />As one travels south along old route 133 in Gunnison County, one <br />suddenly encounters a barrier that stretches half way across the <br />road (but does not block the road). Attached to this barrier is <br />a sign warning of blasting taking place in the area. However, <br />there is no sign indicating whether the barrier represents an <br />edge of the Sanborn Creek Mine permit area or if this is actually <br />an entrance to the permit area. What is sure, however, is this <br />is a public access point to the Sanborn Creek Mine. In <br />accordance with Section 715.12 (b) of the Surface Mining Control <br />and Reclamation Act, signs identifying the mine area shall be <br />displayed at all points of access to the permit area from public <br />roads and highways. <br />The sign indicating blasting is clearly located on a public <br />right-of-way and does not restrict citizen access to the blasting <br />area. As mentioned above, there is no indication that the sign <br />represents the permit boundary and absolutely nothing prevented <br />unwary citizens from wandering into a potentially deadly blasting <br />1 <br />
