-47- <br />Rules 4.03 and 4.05 present specific design and performance standards <br />that mine drainage and sediment control systems must meet. The <br />application discussion and engineering designs for the mine and loadout <br />systems were reviewed to ensure compliance with these rules. Although <br />problems were identified with the systems early in our review process, <br />all problems have since been resolved. The Division finds the <br />application and operation in compliance with these requirements. <br />Based on the information presented in the application concerning mine <br />facilities; coal handling structures; roads; and ponds, impoundments and <br />diversions, the Division finds the application in compliance with the <br />requirements of this section. <br />XVI. Explosives - Rules 2.05.3(6)(a) and 4.08 <br />Rules 2.05.3(6)(a) and 4.08 contain specific information requirements and <br />performance standards with regards to use of explosives. This operation <br />does not use or propose to use explosives as defined by the Regulations. <br />Therefore, the requirements of this section do not apply to the mine <br />operation. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />XVII. Backfilling and Grading - Rules 2.05.316). 2.05.3(9), <br />2.05.4(2)(a). 2.05.4(2)(c), 4.09, 4.13 and 4.14 <br />The applicant proposes to reclaim all disturbances within the permit <br />area, with the exception of several roads proposed for retention. <br />Portions of the permit area will be reclaimed prior to 1983, as shown on <br />Drawings D-4-14 through D-4-16. The majority of the permit area <br />disturbances will be reclaimed upon cessation of mining, in accordance <br />with plans delineated on Drawings D-4-17 through D-4-20. <br />The post-mining topography proposed by the applicant, with the exception <br />of the coal processing waste pile and several retained roads, conforms <br />with the requirements of Rule 4.14. Stability analyses performed as a <br />portion of the approved tecfinical revision providing for the installation <br />of a new waste pile access road, combined with on-site experience in <br />reclamation of an older access road to the processing waste disposal <br />area, have demonstrated that the proposed backfilled configurations can <br />be completed in stable condition. <br />All underground development waste, excess spoil and coal processing waste <br />are to be deposited in an approved disposal area, as discussed in Section <br />XVIII of these findings. No acid-forming or toxic-forming materials were <br />identified within the mine bench. Therefore, no special handling will be <br />needed when the bench is backfilled and graded. All non-coal waste will <br />be disposed of within the refuse pile in accordance with the approved <br />plan. <br />
