III IIIIIIIIIIIIIIII <br /> <br />Attaeb~ant A <br />epeeial Leasa Stipulations <br />1. The operator shall immediately cease all operations upon discovery <br />of fossil(s) of scientific value and will immediately notify the <br />Authorized Officer. The BLH shall evaluate and/or cause to be <br />removed such discoveries within 48 hours. The BLK may negotiate <br />additional time if mutually agreeable to the lessee and BLN. <br />The coat of any required paleontologic surveys and recovery of any <br />fossil(s) of scientific value discovered during operations shall be <br />borne by the lessee. <br />If cultural resources are discovered during operations, the lessee <br />shall immediately notify the OSM Regional Director or the BLH <br />Authorized Officer. The lessee shall not disturb such discoveries. <br />Within five (8) working days, the Regional Director (or Authorized <br />Officer for the appropriate surface management agency) will <br />evaluate, or cause to have evaluated, any cultural resources <br />discovered and will determine if any action may be required to <br />protect or preserve these discoveries. Cost of recovery/mitigation <br />of these resources shall be borne by the lessee. <br />• <br />• <br />4. This lease is subject to valid rights existing on the date of lease <br />issuance. <br />5. If surface disturbance ie proposed or becomes likely at <br />archaeological site SRT32, mitigative excavation of the site will <br />be required. The lessee moat submit a mitigation plan to the <br />Authorized Officer for review and approval. <br />6. Work will be conducted .at archaeological site SRT345 to mitigate <br />possible adverse effects of subsidence prior to undermining the <br />site. The work moat include: 1) mapping, drawing, photography, and <br />dating of the rock art, and 2) rockehelter excavation. The lessee <br />must submit a mitigation plan to the Authorized Officer for review <br />and approval. <br />7. The lessee will document consultation with Ute and Shoshone tribal <br />councils regarding the proposed mining and its possible effects on <br />SRT345 and any religious concerns of the tribes. <br />8. No surface operations or surface impacts are authorized within the <br />boundaries of the Fieh Creek alluvial valley floor (AVF) or <br />floodplain: T.SN., R.87W., sec. 36, NW~NW}NW1~. <br />SONPLIANCE AND MONITORING PLAN <br />Compliance and monitoring will be carried out as outlined in the District <br />Solids Inspection and Enforcement Strategy. In summary, the strategy <br />requires lease inspections be carried out quarterly from the date of <br />lease issuance. <br />
