The purpose of this letter is to certify that at a meeting of the Board
of County Commissioners of the County of Boulder, State of Colorado,
duly called and held on Monday, August 22, 1977, the following ac~:ion
was taken:
The Board of County Commissioners of the County of Eoulder, `.Mate
of Colorado, APPROVED, subject to the following conditions:
1. In addition to commitments ofi record in this proposal, F~re-
vious conditions of approval and commitments of record, when not
modified by this amendment, remain in full effect, and further
including additional information submitted by t9estern Paving Con-
struction in documents of file dated April 22 and April 27, 1977.
2, Fulfillment of the appropriate requirements of other agencies.
3. If the concept of the operation should change from using the
train to transport 90% of mined material from the site, the modifi-
cations will be submitted to Boulder County for review.
4. The Company will, if requested by the Conservancy District,
submit a plan for augmentation to the 4Jater Court for final deter-
mination as set forth in Paragraph 2.f of the agreement.
