As a result of review by the Office of Mined Land Reclamation of your permit application,
pertinent geology and geochemistry and recent inspection reports, you aze hereby notified,
pursuant to Rule 7.2 of the Mineral Rules and Regulations of the Colorado Mined Land
Reclamation Board, that your Sunday Mine, Permit No. M-77-285, has been determined by
the Office to be a Designated Mining Operation for the following reason:
1. Toxic-forming materials aze or will be exposed or distultied as a m:sult of
mining operations. Waste rock dumps are exposed to rain and snowmelt
runoff possibly causing offsite contamination.
If you agree with this designation, you are required to notify the Office by mail of your
concurrence within 30 days of the date of this notice and to proceed to comply with the
requirements of subsection 7.2.3 of the Mineral Rules. If you disagree with this designation,
you may appeal in writing to the Office within 30 days of the date of this notice.
