-I1- <br /> <br />Postmining land use comments have been received from the surface owners <br />of the disturbed area, Routt County and Knott Land and Livestock <br />Company. Routt County has officially requested, in writing, that County <br />Road No. 29 remain as a postmining land use. <br />Pursuant to Rule 2. U7.6(2)(1), the Division approves the proposed <br />postmining land use for the Apex No. 1 Mine <br />III. Cultural and Historical Resources - Rules 2.04.4 and <br />Information appropriate to Cultural and Historical Resources can oe found <br />on pages 14-22 of the application. The Colorado Historical Society <br />states on page 20.1 of the application that no cultural or Historical <br />resources listed~on the Naional kegister of Historic Places are contained <br />within, or adjacent to Sunland I.lining Corporation's permit area. <br />IV. Geology -Rules 2.04.5 and 2.04.6(2) <br />The applicant has supplied a description of the geology of the pe nnit and <br />adjacent areas in Section 2.04 pages 24-49 of the application. A general <br />overview of the geologic environment is contained in the Description of <br />the Existiny Environment of this document. <br />The roof and floor analyses for the three seams provided by the aoplicant <br />show that, although water coming in contact with the interburden naterial <br />will be slightly degraded, no critical levels of any chemicals will be <br />generated. In fact, the water would only be sliyhtly sodium-sulfate in <br />nature. This conclusion is based on the following facts: <br />1. The potential pH would be near neutral, which would prohibit <br />most heavy metals from being liberated; <br />2. Although mercury and cadmium levels are high, these elenents <br />are not responsive in a neutral environment; and <br />3. Furthermore, mercury is only Detrimental when combined Nith <br />certain organic compounds which are unavailable in a coal mining <br />environment. <br />Additional discussion of water chemistry at the Apex No. 2 I4ine is found <br />in Sections IV, V and Ix. <br />V. Hydrologic Balance; Surface Water - Rules 2.04.5, 2.04.7 <br />The information provided by the applicant dealing with surface water <br />quality, surface water quantity and sedimentation control can be found in <br />Section 2.04.7 and 2.05.3(4) of the application. <br />
