PROPOSED DECISION <br />The Colorado Division of Minerals and Geology proposes to approve an application for partial Phase One <br />Bond Release submitted by Bowie Resources Limited for the Bowie No. l Mine, Permit Number C-1981- <br />038. The proposed decision is based on successful completion of structural demolition and removal and <br />portal sealing at the East Mine and structural demolition, portal sealing, backfilling and grading work and <br />drainage control at the West Mine, within specified portions of the permit area as described in the bond <br />release application. In addition, the Division is proposing to approve an application submitted by Bowie <br />Resources Limited for a bond reduction for the reclamation of certain facilities that were never <br />constructed. The mine is an underground coal operation located in Delta County approximately four (4) <br />miles north of Paonia, Colorado, with the loadout located approximately one (1) mile east of Paonia, <br />Colorado. The permit area contains approximately 8,670 acres of land within the following sections: <br />Township 13 South, Range 92 Wes[, 6'" P.M. <br />Sections: 1, 2, 10, 11, 12, 13, 14, 15, 22, 23, 24 and 25 <br />Township l3 South, Rang 92 West, 6`s P.M. <br />Sections 5, 6, 7, 8, l7, 18, 19, 29, 30, 31 and 32 <br />The permit area is contained within the U.S. Geological Survey 7.5 minute Bowie and Gray Reservoir <br />Quadrangle maps. <br />In the partial Phase One Bond Release (surety release SL-02), the Division is proposing to release a total <br />of $1, ] 43,807.00 for the structural demolition and disposal and portal sealing at both the East Mine and at <br />the West Mine and backfilling and grading work and drainage control at the West Mine, as detailed in the <br />Division's Proposed Decision and Findings of Compliance for the Partial Phase One Bond Release <br />(surety release SL-02). Also included in the bond release amount is a bond reduction for the reclamation <br />of the rock slope tunnels and two associated culverts at the East Mine which were never built. The total <br />reclamation liability at the Bowie No. 1 Mine amounts to $6,879,590.00. With the proposed decision to <br />approve SL-02, the total reclamation liability will be $5,735,783.00. The Division currently holds <br />Corporate Surety Bond No. in the amount of $5,450,000.00 issued through the CGU Insurance <br />Company. The Division also holds Corporate Surety Bond No. in the amount of <br />$],000,000.00, issued through the Lyndon Property Insurance Company. Therefore, enough bond money <br />will be retained in order to perform the remaining reclamation tasks at the Bowie No. 1 Mine. <br />A copy of the "Proposed D d Findings of Compliance", including reclamation cost summary <br />sheets, is on file for public inspection at the Colorado Divi nd Geology, Room 215 <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203, at the Paonia Public Library, 140 <br />Grand Avenue, Paonia, CO 81428 and at the Delta County Clerk's Office, 5th & Palmer, Delta, CO <br />81416. Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Requests for a public hearing must be received by the Division within thirty days of the first <br />publication in the Delta County Independent. The request must be in writing and must state, with <br />reasonable specificity, the reasons for requesting such a hearing. All requests must be submitted to the <br />Colorado Division of Minerals and Geology, 1313 Sherman Street, Room 215, Denver, Colorado, 80203. <br />If no hearing is requested within that thirty days, the Division's decision will become final. <br />14 <br />
