Page 35 <br />Hazd Rock/Metal Mining Rule 1 <br />(3) Approval of a permit transfer and succession of Operator request shall <br />be given by the Office if it finds that the successor Operator is capable of a.ec„ming <br />all responsibility for the conditions included under_the original permit. Notice of <br />Permit Transfer wr71 be acknowledged in the monthly activity report attached to the <br />monthly Board agenda. <br />11a 1.12.2 Deniat and Appeal Process <br />(1) In the event that the Office decides to deny a succession of Operator <br />_. __ ___ ___..._ _.. _ _ .... _. aPPlication, the Office w>71 notjfy the.Applicantin_veriting.within ten (10~ days ofshe_ _ _ . <br />decision deadline. <br />(2) The Applicant tnay appeal the Office's decision to the Boazd for a final <br />determination according to the provisions of Paragraph 1.4.11. <br />103(6) 1.13 TEMPORARY CESSATION <br />1.13.1 General Pmvisioms <br />(1) Apermit granted pursuant to these Rules shall continue in effect as <br />long as: <br />(a) an Operator continues to engage in the extraction of minerals <br />and/or the mining operation and complies with the provisions of the Act; and <br />(b) mineral reserves are shown by the Operator to remain in the <br />mining operation. <br />(2) The Board wr71 consider all relevant testimony and facts related to a <br />mining operation in its determination as to whether or not temporary cessation has <br />occurred. The Board recognizes that no one factor is necessarily determinative, but <br />that each determination wr71 be based on site-specific conditions. Factors to be <br />included in the determination if a mine wr11 be considered for temporary cessation, <br />include, but aze not limited to the following: <br />1.13.2 Indications of Temporary Cessation <br />(1) there aze no personnel working at the site for one hundred eighty <br />(180) consecutive days; <br />
