III IIIIIIIIIIIII III • FS Agreemen'r No. <br />MEMORANDUM OF UNDERSTANDING <br />between <br />USDA FOREST SERVICE <br />and the <br />TELLURIDE GRAVEL, INC. <br />THIS MEMORANDUM OF UNDERSTANDING i5 hereby entered into by and between tt~e <br />USDA Forest Service hereinafter referred to as the Forest Service, and the <br />Telluride Gravel, Inc. hereinafter referred to as Telluride Gravel <br />A. PURPOSE. <br />The Telluride Gravel and the Forest Service are desirous of improviny the <br />aesthetics and aquatic/riparian stability of the confluence of the San <br />Miguel and South For}: of the San Miguel rivers. <br />B. STATEMENT OF MUTUAL INTERESTS AND BENEFITS. <br />It is in the best interest of Telluride Gravel and the Forest Service to <br />resolve unwillful trespass in a cooperative manner. It is also in the <br />best interest of the public, both socially and environmentall}', to have <br />the project come to completion. <br />C. FOREST SERVICE SHALL: <br />I. Be responsible for providing final plans and drawings for the project. <br />2. Provide grade and ~levation staking and surveying for the project. <br />3. Waive the costs of royalties and land damages due the government in <br />lieu of work performed ($90,500 and $16,000 respectively). <br />4. Inspect the progress of work and make-changes as necessar}' to the <br />completion of a quality job. <br />5. Cancel the Bill for Collection for $566,190 issued on 10/5;99 upon <br />completion of the wor}:. <br />6. Obtain a 909 permit from C.O.E. and adhere to its provisions. <br />7. Conduct monitoring required in 904 permit. <br />2. The TELLURIDE GRAVEL shall: <br />1. Agree to scope of work to be performed to offset C.3. above. <br />2. Provide the Forest Service with a schedule of planned actions to <br />accomplish this work. <br />3. Furnish the required equipment and workforce to accomplish the agreed <br />to work as set forth in the final plans, drawings and specifications. <br /> <br />~,a, <br /> <br />
