Mills <br />Ptined Land Reclamation Division <br />Department of Natural Resources <br />723 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />On or about March 26, 1980, Energy Fuels Corporation ("Energy Fuels") <br />received the Office of Surface Mining's ("OSM") approval, with stipulations, <br />of a mayor modification to the Surface Mining and Reclamation Plan for Energy <br />No. 1 and Energy No. 2 Mines and Extension into Eckman Park, One of the <br />special stipulations, number 15, provided as follows: <br />"15, No coal seams (Lennox, rider seams, Wadge) or coal seam <br />splits 28 inches or greater in thickness will be spoiled or <br />left unmined without the express written consent of the regula- <br />tory authority and the USCS Area Mining Supervisor. The Area <br />Mining Supervisor may require the mining of coal seams or <br />splits that are less than 28 inches in thickness." <br />This letter constitutes Energy Fuels' request that the regulatory author- <br />ity and the USCS consent to the spoiling of the Lennox coal seam which lies <br />stratigraphically above the Wadge coal seam until such time as a market can be <br />found for this coal. <br />
