Mills Ptined Land Reclamation Division Department of Natural Resources 723 Centennial Building 1313 Sherman Street Denver, Colorado 80203 On or about March 26, 1980, Energy Fuels Corporation ("Energy Fuels") received the Office of Surface Mining's ("OSM") approval, with stipulations, of a mayor modification to the Surface Mining and Reclamation Plan for Energy No. 1 and Energy No. 2 Mines and Extension into Eckman Park, One of the special stipulations, number 15, provided as follows: "15, No coal seams (Lennox, rider seams, Wadge) or coal seam splits 28 inches or greater in thickness will be spoiled or left unmined without the express written consent of the regula- tory authority and the USCS Area Mining Supervisor. The Area Mining Supervisor may require the mining of coal seams or splits that are less than 28 inches in thickness." This letter constitutes Energy Fuels' request that the regulatory author- ity and the USCS consent to the spoiling of the Lennox coal seam which lies stratigraphically above the Wadge coal seam until such time as a market can be found for this coal.
