Recommendation
I recommend termination of Federal permit CO-031, issued on October 15, ~
1982, for the Henry and Opal Weaver Ohio Creek No. 2 mine. My
recommendation is based on the existence of the Colorado cooperative
agreement which provides for tie delegation to tree Colorado Mined Land
Reclamation Division (CMLRD) of the permitting responsibilities for
operations on Federal lands pursuant to Section 523 of SMCRA; the
issuance of the Colorado State permit CO-80-002; incorporation of all
necessary Federal permit conditions in the State permit; and review of
the mining plan approved on March 2, 1982, for Federal lease, C-069942.
The applicable conditions of the existing approval of the mining plan,
which were previously incorporated in the Federal permit, are appended
to this memorandum as Attachment A.
The termination of the Federal permit is being done in conjunction with
the renewal of the Colorado State permit. Colorado MLRD has reviewed
the permit application package (PAP) under the Colorado State program,
the Federal lands program (30 CFR Chapter VII, Subchapter D) and the
Colorado cooperative agreement (30 CFR 906.30) and has issued Colorado
permit CO-80-002 xhich authorizes surface coal mining and reclamation
operations on Federal and non-Federal lands in the permit area pursuant
to the State program, and cooperative agreemert. A copy of the bond in
the amount of $36,000, payable to the United States and the State of
Colorado, is on file with OSMRE.
This permit termination is categorically excluded from the National
Environmental Policy Act (NEPA) process because the Federal permit and
mining plan approval were previously covered by the NEPA process (i.e.,
OSMRE's Environmental Assessment and Finding of No Significant Impact
dated Mqy 27, 1987).
