4/21/92 Colorado Department of Health and Boulder County Department of <br />Health notified by the Division of the unpermitted erosion and <br />tailings discharge which ran off site as noted on the 4/16/92 <br />inspection report. <br />4/21/92 Co-permittees notified by the Division that the three Cash Mine and <br />Mill possible violations and the request for reconsideration of <br />NOV No. M-92-021 will be continued to the May Board meeting. <br />4/21/92 Division sent a summary of points of understanding reached at the <br />4/13/92 meeting with COM, Inc. to COM, Inc., Gold Hill Ventures, <br />and Mr. Freirich, the original complainant. <br />4/22/92 Mrs. Fraser of COM, Inc. asked the Division to support a request to <br />continue the possible violations to be considered by the Board to <br />the May meeting. It was also requested that civil penalties levied <br />against the co-permittees be continued until the May Board meeting. <br />4/23/92 Mined Land Reclamation Board continued the Cash Mine and Mill <br />matter to the May Board meeting. Civil penalties as per NOV <br />No. M-92-021 of $23,370.00 are due and payable on 4/28/92. <br />4/24/92 Division informed Mr. Tatman that modifications to the permit <br />cannot be processed until all civil penalties on the permit are <br />paid. <br />Gold Hill Ventures submitted a Request for Reconsideration of NOV <br />No. M-92-021. Copies sent to COM, Inc. <br />4/27/92 Division letter faxed to co-permittees confirming the Board's <br />continuation of the Cash Mine and Mill matters to the May Board <br />meeting and the civil penalty assessed in NOV No. M-92-021 was due <br />and payable by 4/28/92. <br />Mrs. Fraser, COM, Inc., paid $11,685.00 of the $23,370.00 civil <br />penalty. <br />5/04/92 Mrs. Fraser and Mr. Tatman submitted 110(2) permit application for <br />Bueno Mine. They said they are trying to work the problems out <br />with the Steen family. <br />5/12/92 NOV No. M-92-021 was sent to the Attorney General and Collections <br />to collect the balance of the civil penalty. The Board and <br />Division received a letter from a friend of the town of Gold Hill <br />concerning the four possible violations. <br />5/22/92 Division inspected the site. Division recommended withdrawing the <br />possible violation concerning patching the tailings pond liner. <br />Division plans to bring the other two possible violations before <br />the Board. <br />bjw/3215F <br />-3- <br />
