The response to your three items in question are <br />as follows: <br />1. On Monday, April 1, I discussed the need to haul coal <br />from the Elk Creek Facilities to the Terror Creek Loadout with <br />Mr. Tony Waldron, Colorado Division of Minerals and Geology by <br />telephone. After he discussed the request with his supervisor, <br />Mr. Dave Berry, he telephoned me, and stated there were no <br />Division rules or regulations that would require a revision to <br />the permit from the Division for hauling coal off-site to Terror <br />Creek. I will call him again today to ask for the written <br />confirmation you have requested. <br />2. On Monday, April 1, I discussed the need to haul coal <br />from the Elk Creek Facilities to the Terror Creek Loadout with <br />Mr. Charles Dunn and Mr. Joe Vickers, Colorado Department of <br />Transportation by telephone. After discussing the requirements <br />of the existing highway access permit, and in particular noting <br />the 25 mph speed limit in the Town of Somerset, Mr. Dunn stated a <br />new highway access permit would not be required. I will call him <br />again today to ask for the written confirmation you have <br />requested. <br />I also offered to talk with Mr. Vickers, and discuss <br />possible improvements to the intersection, even though it was not <br />required and the space for improvements is limited. Mr. Vickers <br />was receptive to working with Oxbow Carbon and Minerals on any <br />improvements we chose to make over and above the requirements of <br />the existing highway access. On Wednesday, April 3, Mr. Gary <br />Boden, of Beavers Construction Co., Hotchkiss, Colorado, was on- <br />site to do a field inspection. He will prepare a proposal for <br />our consideration. <br />P O.
