The Plaintiffs :.gree to dismiss with prejudice their Amended Complaint for Unlawful Detainer previously filed in this action. The Plaintiffs further agree not to assert any claim or demand of any nature whatsoever against the Defendants for damages to the property described in said Amended Complaint for Unlawful Detainer; 2. The Defendant Joe Belden agrees to vacate the promises described in the Coal 1•fining Lease attached to Plaintiffs' Amended Complaint for Unlawful Detainer as Exhibit ++A" and to dismiss with prejudice tf~.e Crossclaim and Counter- claim previously filed in this action. The Defendant Joe Belden agrees to vacate the premises referred to in the above referenced Coal Piining Lease and to do so no 1?ter then seven ~7) days after this Stipulation becomes ^n order of the Court, and said Defendant shall execute a quit claim deed to such premises; 3. The Defendant J. 41. LaFollette agrees [o dismiss +.aith prejudice his Counterclaim and Crossclaira previously filed in this action; 4. Each of the parties hereto shall pay their own attorneys' fees, co+rt costs and other fees and costs incurred in this litigation; 5.
