maintenance of a coal mine waste disposal area. (4.10.1(1)).
B. The disposal area will be inspected on a regular basis by a qualified
professional specialist under the direction of the professional engineer
experienced in construction of similar earth and waste structures.
Inspection by this person was approved by the Division as appropriate
Following revegetation and final inspection, quarterly inspections were
terminated in 1998. (4.10.2(1)).
IX. Coal Mine Waste
No specific approvals granted under this section.
X. Backfilling and Grading
A. The Division has approved the applicant's plan for aone-time disposal of
non-toxic, non-coal debris in a manner designed to prevent contamination
of ground or surface waters. A contingency plan has also been developed
to prevent sustained combustion of flammable materials (4.14.3(1)(a)).
XI. Revegetation
A. The Division proposes to approve the use of introduced species in the
reclamation seed mix. The applicant has submitted information which
shows that the introduced species are desirable and necessary to achieve
the approved post-mining land use, and are not poisonous or noxious
(4.1 5.2(3)).
B. Methods to measure herbaceous cover and production, species diversity,
and woody plant density are discussed in Section 2.05.4(e), pages 2.05-24
to 2.05- 27. These techniques include 25 meter long point-intercept
transects on both the reclaimed areas and the reference area. Production
will be determined by clipping .1 m2 plots along each transect. Transects
will be located randomly. The Division proposes to approve of these
techniques (4.15.7(1)).
C. Comparisons between reclaimed and undisturbed areas, in order to
demonstrate that success criteria of 4.15.8, 4.15.9, or 4.15.10 have been
met, will be based on the following:
Reference areas will be used as opposed to standards. Separate
reference areas for rangeland (grassland) and pastureland (AVF) have
been approved. For the rangeland use, herbaceous cover and production
shall be at least 90% of the cover as determined from the rangeland
reference area with 90% statistical confidence. Species diversity will be
deemed adequate when the rangeland reclaimed lands consist of a
12
