At no time in the two and one-half years of operation hwa <br />Terror Creek Company ever received a violation notice from the <br />Division or other State regulatory authority; a record of which we <br />are proud and will make every effort to maintain. However, Terror <br />Creek Company operates a coal processing and sizing facility and <br />there will be a certain amount of dust generated and released in <br />such operation. The permits held by Terror Creek recognize this <br />fact. It is the contention and belief of Terror Creek Company <br />that such coal dust as may be present upon fruit trees owned by <br />Kuretich is minimal, of no harm to the trees or fruit, and is <br />within the permitted allowance for such release. <br />Terror Creek Company has many responsibilities; not the least <br />of which is the approximately 60 coal miners and their families <br />who awe their livelyhood to the operation of the loadout 4acility. <br />This is not to say or imply that Terror Creek Company is to be <br />favored over Kuretich or any other individual or that the company <br />should not be held responsible for its actions. However, the <br />Company has bent over bac4cwards to assist and answer alledged <br />problems of Kuretich including the construction of a (250,000 <br />private access road to avoid use of the public county road <br />adjacent to Kuretich's house, paving of said access road at a cost <br />of 555,000 to cure what may have been a road dust problem, plus <br />the purchase and operation of a water truck at substantial cost <br />over contractual water hauling. And the latest request through <br />the Divisions request for a proposal to apply dust control <br />chemicals on the coal storage pad, instead of water, at a cost o4 <br />approximately #10,000 per year. <br />Terror Creek Company does recognize the source of alledged <br />problems to be Kuretich, who is in the employ of Coors Energy <br />Company. Mr. Lou Gaspar, farmer executive of Coors Energy and <br />Kuretich's supervisor, stood in front of my office and told me <br />personnally, "We Ci.e.Coors] can put you out of business any time <br />we want. All we have to do is complain to the right bureaucrat." <br />Terror Creek Company does not intend to let this happen. <br />Terror Creek Company does not request, expect nor desire any <br />special treatment as regards the alledged problem of dust and the <br />Kuretich orchard. No action on the part of the Division is <br />expected regarding this letter; however, we do wish to make known <br />to .the Division other facts and theories pertainent to the <br />situation of which the Division may or may not be aware. <br />(4) <br />
