<br />NOV ~ ~ 1995 <br />*fON <br />~i"~ vcces <br />November 5, 1985 <br />Ms. Susan Mowry <br />Reclamation Specialist <br />MINED LAND RECLAMATION DIVISION <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Terror Creek Loadout <br />Mine IDq C-83-059 <br />Dear Ms. Mowry: <br />I have received and read with some interest your inspection <br />report of October 16, 19851 specifically as regards comments <br />concerning Mr. Bob Kuretich and alledged damage to his apple crop <br />from coal dust, This letter is in response to certain allegations <br />and statements in the inspection report that Terror Creek Company <br />feels to be in error or, at the least, misleading to the Division. <br />The inspection report states one bin of apples was shown to <br />you by Mr. Kuretich. The subject bin was reported to be <br />" ..heavily covered with coal dust." This would imply said apples <br />to be completely enclosed with a thick layer of black coal dust. <br />However, later in the same paragraph of the report, the subject <br />apples were stated to exhibit "...considerable coal dust, <br />especially at the blossom and stem ends." <br />As you are aware, Terror Creek Company also grows 4ruitp <br />specifically red and golden Bartlett pears plus red delicious, <br />golden delicious and Rome apples. This fruit is grown in equal or <br />closer proximity to the Loadout facility than is Kuretich's fruit. <br />It has been our experience that there does indeed appear to be <br />minor surface deposition of coal dust at the blossom and stem ends <br />of the fruit.
