Stipulation No. 44:
1. Revise Windy Gap policy calculations for annual net water depletion.
Coordinate with U.S. Fish and Wildlife Service and provide all information
to the division to review and incorporate into permit. An application for
a technical revision to include the revised information should be received
by December 31, 1992.
Stipulation No. 45:
MCC will submit the following information by December 30, 1992.
1. Maps 56 and 57, Topsoil Removal and Topsoil Replacement Plan, respectively
2. Map 53, Distribution of Surface Facilities and Table 47, Approximate
Topsoil Volumes (6-1-92; V.2.)*
3. Map 54, Sediment Drainage Control Facilities at the West Elk Mine,
Table 43, Diversion and Collection Channels and Table 44, Collection Pipes
4. As built designs for sediment ponds, freshwater pond, and ditches (6-1-92;
Part II.S)*
5. As built designs for stack tubes (6-1-92; Part III.16)*
6. The amount of gob utilized for the stack tube fill (6-i-92; Part III.16)*
7. Drainage configuration for the pad including:
