If you have authorized him to make a request for a Boazd determination and to represent you, the permittee, at a <br />Board hearing, such authorization must be submitted in writing to this office. I am doubtful that this office will <br />receive a written authorization before the deadline for scheduling a hearing for the September Board meeting. <br />However, there is time for submitting it before the October Board deadline. If it is to be submitted, please try to <br />ensure it is received by September 16, 2002, and I will schedule it for the October 16-17, 2002 meeting. <br />Please be aware that the Division's past position was that the offsite stockpiling activity was a problem, and the <br />stockpiled material was removed (see the 10/18/01 inspection report and subsequent correspondence). Ifthe <br />Division observes such activity in the future, and no Boazd exemption to allow it has been ordered, this office will <br />consider it to be a possible violation for offsite damage and will schedule an enforcement hearing. <br />If you or Mr. Bazker have any questions, wish to discuss this further, or simply wish to submit the written <br />authorization (described above), please call or write me at the Division's Durango field office: 701 Camino del <br />Rio, Room 125, Dumngo, CO 81301.
