Road ditches were generally well maintained. Several permanent post-mine channels were designed <br />and constructed as road ditches including PM-9, PM-I5, and PM-17 along Road El and PM-13 along <br />a portion of the South Road. All of these post-mine drainage channels functioning as road ditches <br />were stable and well constructed. <br />Culverts site wide aze cleaz of sediment and debris and functioning as intended. All proposed <br />permanent access roads site wide aze generally in good condition and maintained. Two azeas were <br />noted in the Phase I inspection where ongoing maintenance will be needed. The first is along a <br />portion of the South Road where a significant gully is forming in the location of the road ditch and <br />the second azea is the northern section of Road El where substantial ruts in the road are forming. <br />These locations have been described in previous inspection reports. <br />In accordance with Rule 2.05.5(1)(6), SCC has submitted letters from the landowners (State of <br />Colorado land Boazd, Grassy Creek Holding Company, LLC and Seneca Coal Company) requesting <br />that the corresponding sections of roads within their property boundaries be left open for future use. <br />With this Phase I bond release Proposed Decision, the compliance requirements of Stipulation No. 32 <br />will have been met and the stipulation will be terminated. <br />Topsoil stockpiles throughout the mine site were fully used and the sites were regraded, with <br />exception of Topsoil Piles A and P. Topsoil stockpiles A and P remain for the shop/facilities area <br />and the solid waste disposal site, respectively. As previously discussed these azeas were not included <br />in the Phase I bond release. Though not a Phase I reclamation success requirement, one reclaimed <br />topsoil stockpile azea and associated access road was noted as an area of concern with respect to <br />revegetation. Former Topsoil Stockpile X, located above Post-Mine Channel PM-18 and the access <br />road to the stockpile were recently regraded. The vegetation is spazse and these locations may need to <br />be reseeded. <br />Drainage Reestablishment <br />The following section describes observations and findings regazding drainage reestablishment in the <br />permanent program azeas and interim-law lands at the Seneca II Mine. Observations and findings aze <br />included for the permanent sedimentation ponds and stock ponds because these structures and affected <br />azeas will be included in the Phase I bond release acreages. <br />SCC utilizes sediment ponds primarily to prevent additional contributions of sediment to streamflow <br />or runoff outside the permit area due to mining disturbances. Existing Sedimentation Ponds 002, 003, <br />004, 008, the PECOCO Pond, the Truck Wash Ponds, and Spill Control Pond #2 aze routinely <br />inspected at least every quarter during complete inspections. The pond irilets, discharge structures <br />and embankments aze stable at all pond locations. Pond side slopes and surrounding azeas aze <br />vegetated and stabilized. The permanent sediment ponds including 002, 003, 004, 008 and the <br />PECOCO are included in the Phase I bond release acreage because they aze to remain as permanent <br />impoundments. The Truck Wash Ponds and Spill Control Pond are included with the facilities location <br />and are not applicable to this Phase I bond release. The Truck Wash Ponds and Spill Control Pond will <br />be reclaimed in 2012 with the facilities/shop azeas as indicated on the current Backfill and Grading <br />11 <br />
