-2- <br />PROPOSED DECISION <br />Hayden Gulch Mine <br />The Colorado Mined Land Reclamation Division proposes to approve with <br />stipulations an application for a permit revision to permit C-003-80 submitted <br />by H-G Coal Company far the Hayden Gulch Mine. <br />This approval decision is based on a finding that the proposed operation will <br />comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 1973, as amended, 34-33-101 et seg., and the Regulations <br />promulgated pursuant to the Act. <br />The permit revision application and the stipulations wi]1 become a binding <br />part of the permit upon approval. The stipulations for the Hayden Gulch Mine <br />are as follows: <br />Stipulation PR l: <br />THE APPLICANT WILL SUBMIT TO THE DIVISION WITHIN 45 DAYS OF PERMIT <br />REVISION APPROVAL, A PLAN SUFFICIENT TO CONTROL EROSION OFF THE STEEP <br />SLOPE OF THE AREA ADJACENT TO THE INTERSECTION OF N 378,000 ADJ AND E <br />1,498,000 ADJ. <br />Stipulation PR. 2: <br />BY SEPTEMBER 15, 1984 THE PERMITTEE WILL SUBMIT TO THE DIVISION, COST <br />ESTIMATES FOR RECLAMATION OF THE WORST CASE SCENARIO AT THE HAYDEN GULCH <br />MINE DURING THE REMAINING LIFE OF THE MINE. THESE COST ESTIMATES WILL BE <br />ACCOMPANIED BY A MINE PLAN MAP DEPICTING THE WORST CAST SCENARIO: TABLES <br />OF AMOUNTS AND LOCATIONS OF MATERIAL TO BE REPLACED AND/OR MOVED: RENTAL <br />RATES BASED ON 1984 RENTAL RATE BLUE BOOK COSTS, PRODUCTION RATES BASED <br />ON THE CATERPILLAR PERFORMANCE HANDBOOK ED.13 OR NEWER) OR OTHER <br />MANUFACTURER PRODUCTION HANDBOOK, AND CONSTRUCTION COSTS BASED ON THE <br />MEANS CONSTRUCTION COST DATA PUBLICATION, OR OTHER PUBLISHED COST DATA. <br />Explanations of the stipulations can be found in Section XIII and XIV of the <br />Findings part of this package. <br />The permit revision will but be effective until all statutory notice and <br />public comment requirements have been satisfied. <br />
