-7 - <br />The operation is in compliance with the requirements of this Section. <br />II. Land Use -Rules 2.04.3, 2.05.5, and 4.16 <br />The applicant plans to return the disturbed area to rangeland and wildlife <br />habitat (see Section 2.05.5 of Volume I). Pre-mining land use in the area was <br />rangeland and wildlife habitat, as determined through inventories and <br />historical records. This land use is consistent and compatible with adjacent <br />land uses. <br />Pursuant to Rule 2.07.6(2)(1), the Division hereby approves the post-mining <br />land use of the operation. It is determined that rangeland and wildlife <br />habitat meet the requirements of Rule 4.16. <br />The operation is in compliance with the requirements of this Section. <br />III. Cultural and Historic Resources -Rules 2.04.4 and 2.05.6(4) <br />Based on cultural resource inventories supplied by the applicant and reviewed <br />by the State Historic Preservation Officer, it has been determined that no <br />cultural and historic resources listed on the National Register of Historic <br />Places have been identified within the permit area. <br />Pursuant to Rule 2.07.6(2)(e), the Division finds that mining operation will <br />not adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. <br />The operation is in compliance with the requirements of this section. <br />IV. Hydrologic Balance: Surface Water -Rules 2.04.5, 2.04.7, 2.05.3(4), <br />L.VJ.V,J~, VIIV `I.VJ <br />The surface water quantity and quality portions of the permit application can <br />be found in Section 2.04.7 (Volume I), Appendix I (Volume IV), Appendix L <br />(Volume V) and Appendis S (Volume UIII). Surface water quality data for the <br />smaller drainages are given in Exhibit CC of the volume entitled Exhibit II. <br />The portions dealing with diversions, sediment control and discharge <br />structures can be located in Sections 2.05.3 and Appendix E, Volume III. <br />The only effect on surface waters at the mine resulting from the proposed <br />permit revision involves the extent of mining. The original mine plan <br />projected advance into the Dowden Gulch watershed. The permit revision <br />proposes that mining will not advance into the Dowden Gulch watershed. The <br />surface water of Dowden Gulch will not be affected by the mining proposed in <br />the permit revision. <br />The operation is in compliance with the requirements of this section. <br />
