Long <br />Division DireUOr <br />You had asked me to research the issue concerning the gob pile haul road certification for the <br />Bowie No. 2 Mine, and how it relates to the relevant showing of Rule 4.03.1(1)(d)(ii). You had <br />mentioned that the relevant showing in 4.03.1 (1)(d)(ii) applied to permitted roads built before <br />August 1, 1995, not for railroad beds built before August 1, 1995 that would later become haul <br />road subgrades. <br />The operator had submitted an initial certification for the gob pile haul road, dated January 9, <br />1998. In response, we sent a letter to the operator, dated January 23, 1998, in which we requested <br />more information for the certification. In that response, we stated that the `'railroad subgrade is <br />acting essentially as a haul road which had been constructed prior to August 1, 1998." <br />This would seem to complicate the issue. There seem to be other problems as well with the <br />certification. The latest certification states that not all of Rule 4.03.1 has been met. Also, at the <br />end of the certification it is stated that the road profile is not according to the permitted profile <br />shown on the permit application drawing. If the issue of this certification comes up during the <br />OSM oversight, I intend to explain that we have just received the latest certification and need <br />time to review it. I have attached. to this memo, the three letters referenced above. I am staying at <br />the Redwood Arms Motel in Paonia if you would like to discuss this further.
