<br />Walker Refractories ("Harbison-Walker"), will be heard by t2ie <br />Honorable Judith A. Boulden, United States Bankruptcy Judge,,:.on <br />Wednesday. September 29. 1993; at the hour of 3:00 p.m., or as <br />soon thereafter as counsel may be heard, in Judge Boulden's <br />Courtroom located on the third floor of the Federal Courthouse <br />Building located at 350 South Main Street, Salt Lake City, ~7tah. <br />The Motion requests approval of a settlement of the above- <br />captioned adversary proceeding between the parties. CF&I brought <br />this action against Harbison-Walker alleging that certain <br />transfers made to it constitute avoidable preferences under <br />it U.S.C. § 547(b). The parties have agreed to settle the matter <br />with CF&I making a payment of $20,000.00 to Harbision-Walker and <br />Harbision-Walker waiving all claims against the Debtors' estates. <br />Copies of the Motion and the related Settlement Agreement may be <br />obtained by request from the undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Tuesday, September 21, <br />1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and :served <br />objections, the hearing may be stricken and the relief sought in <br />2 <br />
