Summary <br />The Review Process <br />On November 05, 1992, the Division notified Sun Coal Company that the Meadows <br />No. 1 Mine permit would expire on August 09, 1993. The letter stated a <br />requirement that application for a permit renewal must be made no later than <br />February 10, 1993. Sun Coal Company submitted the application on <br />January 13, 1993. The application was deemed incomplete on January 15, 1993. <br />Sun Coal Company submitted additional information on January 25, 1993. The <br />application was deemed complete by the Division on February 05, 1993. Sun <br />Coal Company published its intent to renew in The Steamboat Pilot once a week <br />for four consecutive weeks, from February 25, 1993 to March 18, 1993. The <br />Division notified Federal, State and local governmental authorities as <br />required by Rule 2.07.3(3>(b). No comments on or objections to the renewal <br />were received. <br />The Division reviewed the application to determine whether it would comply <br />with the Rules and Regulations of the Colorado Mined Land Reclamation Board. <br />Adequacy concerns were related to the operator on April 27, 1993. The <br />operator has not yet responded to the letter. Since there has been no <br />response, the following stipulation is placed on the Division's decision to <br />renew the Meadows No. 1 permit: <br />Stipulation No. 13 <br />WITHIN THIRTY (30) DAYS OF THE DIVISION'S PROPOSAL TO APPROVE THE <br />MEADOWS N0. 1 MINE PERMIT, SUN COAL COMPANY MUST SUBMIT A TECHNICAL <br />REVISION APPLICATION WHICH ADEQUATELY ADDRESSES AND RESOLVES THE <br />CONCERNS RAISED IN THE DIVISION'S PRELIMINARY ADEQUACY REVIEW LETTER <br />DATED APRIL 27, 1993. <br />The Division reviewed the operator's compliance history using the Applicant <br />Violator System (AVS), and through queries of other states in which Sun Coal <br />Company and its owners and controllers operate. Compliance information <br />requests were sent to other states on February 11, 1993. After Sun Coal <br />Company sent additional ownership and control information, the states were <br />again queried on February 17, 1993. With the exception of the State of <br />Kentucky, no compliance problems were reported. A representative of the <br />Kentucky Department of Surface Mining Reclamation and Enforcement reported <br />that A.T. Massey, owner of Sun Coal Company, had outstanding problems which <br />require permit conditioning in Kentucky, but that Sun Coal Company was not <br />permit blocked. <br />The Applicant Violator System recommendation on February 16 and 26, 1993 was <br />that the permit could be issued. March 02 and 09, 1993 AVS checks resulted in <br />recommendations that the permit be conditionally issued, pending the outcome <br />of an Abandoned Mined Land Fee Audit of an affiliate of Sun Coal Company. A <br />subsequent AVS check on April 28, 1993 reiterated the recommendation to <br />conditionally issue the renewal. A June 07, 1993 query resulted in a <br />recommendation that the permit renewal be denied, and that an affiliate of <br />Sun Coal Company had forfeited a reclamation bond.
