Water District 71 <br />Dear Mr. Brumley: <br />This letter is in response to your application of September 12, 2001 requesting a <br />substitute wafer supply p{an for a sand and gravel pit to be operated by Four States Aggregate, <br />LLC in accordance with 37-80-120 C.R.S. The Applicant shall be responsible for compliance <br />witfi this plan, but the State Engineer's Office may also pursue the landowner for eventual <br />compliance. The required fee of $1,343 for the substitute water supply plan has been paid. <br />This plan describes the water uses for the first year of this new mining operation. <br />The consumptive use of the first year is 9.31 acre-feet. A revision of your monthly <br />breakdown of the annual depletions total 1.73 acre-feet of evaporative loss from a maximum <br />of 1.06 acres of exposed groundwater, 1.22 acre-feet of water used for aggregate washing, <br />3.27 acre-feet of water used and consumed for dust control and 3.09 acre-feet of water lost <br />with the mined product. According to the information submitted, no water surface'was <br />exposed within the permit boundary prior to January 1, 1981. <br />The Lane Camp Pit is located approximately 250 feet from the Dolores River. Lagged <br />effects to the Dolores River are presented in Table 1. The proposed source of replacement <br />water for this pit is the firm yield consumptive use credits from the dry up of historic irrigation <br />on the property that is to be mined. The plan proposes to use 23.49 acre-feet of the historic <br />consumptive use credits from the dry up 21.35 acres of land historically irrigated by the <br />Home Ditch rights that will be taken out of production for this operation. These consumptive <br />use credits will be used to offset the annual depletions created by this operation. The <br />Applicant has entered into a contract with MVIC to store and release replacement water from <br />Groundhog Reservoir for this plan when ditch credits would not otherwise be available to <br />replace depletions to the Dolores River. <br />
