The Division proposes to grant a small area exemption from use of sediment <br />ponds due to the limited size of the area and due to the fact that ponds and <br />treatment facilities are not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams, and also due to the fact that no mixing of surface <br />drainage from underground workings will occur. The small area to be exempted <br />is located along the entrance road on the west side of the entry bridge <br />(4.05.2(3)). Technically, a small area exemption is not needed for this area <br />since the subject drainage is from a road. <br />B. Diversions and Conveyance of Overland Flow <br />Disturbed area drainage is controlled and contained by numerous designed <br />containment ditches. Design details are located in the approved permit application <br />at Section 4.05.3. <br />C. Stream Channel Diversions <br />The Bear Coal Company does not propose permanent or temporary diversion of <br />stream channels. Some flood control work was previously approved and performed <br />along the North Fork of the Gunnison River. Details are provided within the <br />approved permit document at Section 4.05.4. <br />D. Sedimentation Ponds <br />All site sediment ponds are designed and constructed in accordance with Rule 4.05.6. <br />Design details are contained within the approved permit document at Section 4.05.6 <br />and Exhibit 11. <br />Technical Revision No. 10 approved removal of sediment control structures from <br />Bear No. 1 and No. 2. Demonstrations showed that neither site contributed sediment <br />amounts greater than those of adjacent non-mined lands (see Exhibit 25). Backfilling <br />and grading of the sediment ponds at the Bear No. 3 Mine will occur upon successful <br />revegetation of the disturbed area. The flood control Berm will be retained at the <br />Beaz No. 3 Mine due to its enhancement of the light residential use land designation <br />of the Bear No. 3 facilities area. <br />E. Acid-forming and Toxic-forming Spoil <br />Acid-forming and/or toxic-forming materials have not been identified at the Bear <br />Mines. <br />F. Impoundments <br />18 <br />
