approximately 37 gpm. Of particular interest, the water emanating from this spring has an <br />unusually high temperature for groundwater (approximately 80-85 degrees Fahrenheit). The water <br />is currently being diverted by pipe and discharged to the North Fork of the Gunnison River. The <br />Division is continuing to investigate the origin of this water. <br />Surface Water - <br />Surface water information for the Bear Mines is presented in Sections 2.04.7 and 2.05.3 of the <br />Bear No. 1 and 2 permit application, and in Section 2.04.7, 2.05.3 and 4.05 and Map 10 (Mine <br />Facilities) of the Bear No. 3 permit revision application. <br />Surface runoff from the undisturbed portions of the Bear permit area flows directly into the North <br />Fork of the Gunnison River through four small intermittent drainages. The North Fork of the <br />Gunnison is the primary stream in the drainage basin (Figure 5). No surface discharge of mine <br />water is expected from the Bear No. 3 Mine. <br />Surface runoff from the disturbed areas of the Bear Mine is collected by a series of drainage <br />ditches and directed into sedimentation ponds. Effluent from the sedimentation ponds is controlled <br />to meet NPDES effluent standards. <br />Bear Coal Company has had problems with the North Fork of the Gunnison River flooding the <br />facilities area at the Bear No. 3 Mine. Flooding problems may have been aggravated by relocation <br />of the river associated with relocation of state Highway 133. Bear Coal Company has installed <br />a flood control berm adjacent to the North Fork of the Gunnison River to control flooding of the <br />facilities area and to mitigate off-site disturbances related to mining. <br />Water Rights and Replacement -Rules 2.04.7(3), 2.05.6(3)(ii), 2.07.6(2)(c), and 4.05.15 <br />Water rights and replacement information for the Bear No. 1 and 2 Mine is presented in Section <br />2.04.7 of the Bear No. 1 and 2 permit application. Potable water consumed at the <br />site is provided by the Somerset Domestic Waterworks. Water withdrawn from the North Fork <br />of the Gunnison River was used in the mine for dust suppression and other mine-related uses. <br />During operations, the mines annually consumed approximately two acre-feet of water for <br />mine-related activities. <br />Bear Coal has a water right allowing for annual withdrawal of up to seven acre-feet of water from <br />the river. <br />No groundwater is taken from aquifers by the Bear Coal Co. mining operation; therefore, the Bear <br />operation will not adversely affect any groundwater rights.
