~, <br />the extended period. If the Board reduces the length of the postclosure care period, the <br />postclosure financial assurance shall be held until the end of the reduced period. Funds <br />left at the end of the postclosure period will be released to LAC Minerals. <br />3. Until such time as the Department or the Board fmds that the waste impoundment, South <br />Waste Dump, and leach pads are in compliance with all applicable performance standards, <br />the postclosure funancial assurance shall include surety or bonding for contingencies in case <br />of future problems. The postclosure financial assurance would be used in the event that <br />major corrective actions must be taken in the case of operator default, bankruptcy, etc, <br />Such corrective actions would include, but are not necessarily limited to: <br />a. Improvements to, and reconstruction of, the cap on the waste impoundment; <br />b. Designing caps for the remaining waste in South Waste Dump or for the leach <br />pads; <br />c. Addition of base materials to buffer waste rock in the waste impoundment, the <br />South Waste Dump, or the leach pads; <br />d. Mitigation of contaminated groundwater in Spruce Gulch; <br />e. Removal of waste rock from the South Waste Dump or from the leach pads to the <br />pit impoundment or other suitable location; and/or <br />f. Long term water treatment of effluent from the waste impoundment, the South <br />Waste Dump, or the leach pads. <br />At such time LAC Minerals believes they are in full and continuing compliance with <br />applicable performance standards, they may petition the Department and Board for release <br />or reduction of the postclosure financial assurance. The Department reserves the right to <br />recommend to the Boazd an increase in the postclosure financial assurance based on the <br />outcome of condition no. 5 under Postclosure above. <br />4. The type of postclosure financial assurance may be amended upon mutual consent of the <br />Department, the Board, and LAC Minerals. <br />5. The Department and the Boazd reserve the right to increase or reduce the amount of <br />postclosure financial assurance based upon problems at the site, including stability <br />problems, hazards, poor revegetation success, hydrologic impacts, and releases of <br />substances that adversely impact natural resources. <br />1. In January of each year beginning in 1995, LAC Minerals shall schedule a meeting with <br />the Department, the Department of Game, Fish and Parks, and the Department of <br />Agriculture to assess the success of reclamation based on various performance criteria <br />pertaining to the various components of the reclaimed facility. The success of reclamation <br />shall be measured using various water quality, soils, other physical, and biologic-based <br />14 <br />
