C~P010(~y <br />Mr. John Nelson <br />Project Manager GEC East Pit Reclamation <br />RE: Project Completion Date <br />Dear Mr. Nelson: <br />It was brought to my attention today that you have June 18, 1994 as <br />an end date for this project. This date was arrived at by a deduct <br />of 5 days by deleting erosion mat and riprap at the south end of <br />the project. The general condition permits you to add or deduct <br />work, but No. 20 of same says, "The content price and time for <br />completion will be adjusted accordingly by mutual agreement." I <br />will not agree to any days deducted from contract time. I am also <br />computing my costs for the riprap that I sorted for this and will <br />be asking for payment on this item, along with an equipment rental <br />rate for shaping of this ditch as it is much more difficult on a <br />steep slope than the natural ditch being formed by our slope <br />reduction. <br />It was also brought to my attention that you only planned to extend <br />the contract time for the amount of time spent on the hourly <br />equipment rental and not for revegetation. <br />My construction schedule that was accepted by DMG allowed 56 days <br />for revegetation. Seed was not delivered to me until June 13, <br />1994. My schedule should have served as notice as to when I would <br />require seed. I again had to ask for seed on May 20, 1994. <br />I have also asked repeatedly where we will be mulching so I will <br />only have to move the mulch once. You have asked me to hold off <br />getting mulch as it may be deleted. I will require time for re- <br />vegetation after a decision is made. <br />Further, all the slopes were basically topsoiled from the tops <br />about one half the way down when we ran out of topsoil. To finish <br />topsoiling out of the stockpiles that are being moved under <br />equipment rent we have to get back on all these slopes to complete <br />the operations. This disallows us from seeding until all top- <br />soiling is complete on an area.
