Long <br />Drv~aon Direuor <br />On 6/23/97, I succeeded in contacting MSHA Grand Junction office at (970) 245-5251. <br />I had not received response to previous messages left on phone answering machine. <br />During the morning of 6/23/97, I talked to George Rendon, MSHA inspector of non-coal <br />operations. <br />Mr. Rendon indicated that he had inspected the Neal Pit on 4/29/97, in response to injury <br />accident at the Neal Pit occurring on 4/23/97. Mr. Rendon indicated that the victim had <br />entered private property through a gate in a fence line. MSHA did not know if the victim <br />had opened the gate or if the gate had been opened previously by an unknown individual. <br />Mr. Rendon stated that victim had been traveling on an abandoned road, located on <br />private property, and had passed through a gate and fence line to reach the accident site. <br />Mr. Rendon stated that Montrose County had not violated MSHA regulations. <br />I requested copy of MSHA inspection report from the 4/29/97 inspection. Mr. Rendon <br />replied that such requests were handled through the MSHA Denver office (303) 231- <br />5469. Phone conversation with Mr. Rendon was terminated during my attempt to clarify <br />MSHA position. <br />I called the MSHA Denver office at (303) 231-5469. Receptionist stated that MSHA <br />would respond to written requests for copy of inspection reports. Such requests should <br />be addressed to the following address and should reference the location and date of <br />inspection: <br />MSHA <br />P.O. Box 25367 <br />Denver, CO 80225-0367 <br />Attn.: Jane Route <br />FAX: (303) 231-5468 <br />On 6/23/97, at 10:46 hours, I FAXed request letter for copy of referenced inspection <br />report, and followed up with hard copy in mail. FAX verification report stated that FAX <br />to 1303) 231-5468 was received. <br />
