Posey <br />District Ranger <br />U.S. Forest Service <br />Rio Grande Avenue <br />Paoni.a, CO 81428 <br />Dear Mr. Posey: <br />~', fi - f,: I,y1 ~%~ <br />.~_, <br />/. <br />On December 1, 1990, a partnership between the Pacific Basin Resources divi- <br />sion of Oxbow Carbon & Minerals, Inc., and Bear Coal Conq~any, Inc., purchased <br />all of the assets of Kaiser Coal Corporation near Sarerset, Colorado. This <br />property, whidr was previously ormed by Utrited States Steel Corporation is <br />also kno.+n as the Sanerset Mine. <br />Recently, Sotnerset Mining Cong~any began the process of transferring the Colo- <br />rado Flined land Reclamation Permit on the property to our name. As a result <br />of our efforts in this regard we discovered that a small portion of the dis- <br />turbed area on the Somerset Mine property is located upon land owned by t}te <br />United States Forest Service. Specifically, the land is adjacent to the site <br />where United States Steel Corporation had a substation in the Hubbard Creek <br />area. <br />Section 2.07.6, Rule 114(2)(II) of the Regulations of ttte Colorado Mined Land <br />Reclamation Board states t}tat the permit area of a mine cannot be located, "On <br />any Federal lands within the boundaries of any national forest; except that <br />surface coal mining operations ney be permitted on such lands if the Secretary <br />finds that there are no significant recreational, timber, econanic, or other <br />values which ney be incargtatible with such surface mitung operations, and <br />Surface operations and ing~acts are incident to an underground coal mine;". <br />Pursuant to this rule, it is necessary for us to obtain a determination fran <br />the Secretary that do significant recreational, timber, econanic or other <br />values are inccxtg~atible with ttte surface disturbance on the Sanerset nunesite. <br />We therefore respectfully request that your office undertake an evaluation of <br />the disturbance at the Hubbard Creek site, and sutmit your determination to us <br />as soon as possible. <br />Sincerely, <br />SOMERSET MiIdING COMPANY <br />Cra' N pr ng r <br />M r - Manag t Crnmittee <br />cc Jim Stover <br />P.O.
