RM. 270 <br />1823 STOUT STREET <br />DENVER, COLORADO 80202 <br />OFFICE OF THE REGIONAL DIRECTOR <br />June 18, 1979 <br />Sheridan Enterprises, Inc. <br />9745 East Hampden Avenue, x/330 <br />Uenver, CO 80231 <br />Dear Sirs: <br />This letter concerns your coal producing test site operation near Grand <br />Junction, Colorado. <br />Each of your test sites approved in November 1976 would involve production <br />of five coal entries on 80-foot centers extending about 5,000 feet from <br />the surface. Test sites 1l2 and i/3 have not been started and test site ;74 <br />has been idle since November 1978. Test site 1/1 has been mined to 1,380 <br />feet and is still in operation. Approximately 160,000 tons of coal have <br />been mined from [he two sites to date. It is our determination that this <br />operation exceeds exploration needs and that your operation constitutes <br />surface coal mining operations as defined in Section 701(28) of SFICRA. <br />On I•fay 7, 1979, Thomas E. Elunett, an authorized representative of the <br />Secretary of the Interior, inspected your operations to determine com- <br />pliance with 30 CFR 211 and 30 CFk 717. He served a formal Notice of <br />Violation on your employee, Mr. Pete Adler. <br />Notice of Violation Number 79-V-1-12, Violation 1 of 6, requires you to <br />apply for and receive a state m;n;ne and reclamation permit within 90 <br />days of service of the notice. ~ _ .! <br />Federal regulations 30 CFR 211.10(a)(1)(ii) require that you submit a <br />mining plan and obtain the Department's approval of the plan before con- <br />ducting any surface coal mining operation on leased land. <br />You are hereby ordered, under 30 CFR 211.4(a) and 3U CFR 741.11(a)(1) <br />to submit seven copies of a mining plan and permit application to my <br />office before S:OU p.m. on July 6, 1979. You may continue your existing <br />operations a[ test site 1{1 provided you submit [he plan and application <br />within [his time limit. The plan and application must be identical with <br />any permit application submitted to the State of Colorado. It must con- <br />tain information and showings required by 30 CFR 211 and 3U CFR Chapter <br />
