the hour of 2:00 o.m., or as soon thereafter as counsel may be <br />heard, in Judge Bouiden's Courtroom located on the third floor <br />of the Federal Courthouse Building located at 350 South Main <br />Street, Salt Lake City, Utah. The Motion requests approval of <br />a settlement of this adversary proceeding between the parties. <br />CF&I brought this action against ABB alleging that certain <br />transfers made to it constitute avoidable preferences under 11 <br />U.S.C. § 547(b). The parties have agreed to settle the matter <br />with ABB (a) making a payment of $3,500.00; (b) withdrawing its <br />Proof of Claim against CF&I; and (c) waiving the right to file <br />or amend a Proof of Claim based on the $3,500.00 settlement <br />payment. Copies of the Motion and the related settlement <br />agreement may be obtained by request from the undersigned <br />counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and <br />served upon the undersigned counsel on or before Friday, the <br />18th day of June, 1993. Absent timely filing and service of <br />objections, the hearing may be stricken and the relief sought <br />in the Motion may be granted by the Court without further <br />notice or hearing. Additionally, upon the resolution of any <br />timely filed and served objections, the hearing may be stricken <br />and the relief sought in the Motion may be granted by the Court <br />without further notice or hearing. <br />- 2 - <br />
