discussed in our meeting on March 1, 1994, if CYCC would like to
retain the ditch and Pond M as permanent, they are required to be
approved as permanent through a technical revision to the permit
prior to final bond release. At the time of the writing of this
document, an application for a technical revision addressing these
features had not been filed with the Division.
During the field inspection some rills and gullies were observed
which required repair prior to final bond release. In our meeting
of March 1, 1994, the Division requested that these repairs be
handled by a minor revision to the CYCC permit. At the time of the
writing of this document no revision has been filed with the
Division.
The corrective actions required are as outlined below:
* submit statistically valid vegetative data to demonstrate
compliance with the approved permit and with Rule 4.15
* demonstrate through water sampling or appropriate sediment
modelling that all reclaimed areas in Block A do not contribute
suspended solids above baseline conditions
* submit a technical revision to your permit to allow permanent
retention of the west ditch into Pond M or reclaim this ditch.
* submit a minor revision requesting approval to repair those areas
of rills and gullies identified at the Block A bond release
inspection.
You have the right to an adjudicatory hearing as outlined under
Rule 3.03.2(6). The request for an adjudicatory hearing must be
written and state with specificity the reasons why the hearing is
requested and must be received within 30 days of the first
publication of the proposed decision by the Division.
References
Principles and Procedures of Statistics, Robert G.
