<br />6. NOTICES: It is agreed that any notice required or permitted to <br />be given under the provisions of this lease shall be sent by certified mail to <br />the address se[ forth at the beginning of this lease, or to such other address <br />as either party may indicate in writing to the other party, and such service <br />by mail shall be deemed sufficient and in full compliance with the terms of <br />this agreement. <br />7. LESSER INTEREST: In the event Lessor owns a lesser interest in <br />the surface of the premises than .the entire and undivided fee simple estate <br />therein, except where such lesser surface interest is referred to herein, then <br />the royalties, both advance and production, herein provided shall be paid to <br />Lessor only in the proportion that Lessor's surface interest bears to the whole <br />and undivided surface fee, and Lessor shall be entitled to retain only such <br />proportion of any monies previously advanced or paid by the Lessee as said <br />interest of Lessor bears to the whole and undivided surface fee. <br />8. SURRENDER AND RELINQUISHMENT: The Lessee may at any time, by <br />paying to the Lessor the sum of $10.00, together with all amounts then due <br />and performance of all other of Lessee's obligations as provided herein, <br />surrender and cancel this lease insofar as the same covers all of the lands <br />herein leased and be relieved from further obligations or liability. hereunder. <br />9. RIGHT OF REMOVAL: In the event this lease is terminated by <br />forfeiture, surrender or the expiration of term, the Lessee may remove all <br />its improvements and equipment from the said premises and such removal shall <br />be accomplished without unnecessary waste or injury to the premises, within <br />one year from the date of this termination. <br />10. OPERATIONS: Lessee shall conduct its operations in a good and <br />workmanlike manner and shall fully comply with all laws, State, Federal and <br />local. No actual production or disturbance shall occur or begin until all such <br />licenses, approvals or permits have been obtained. <br />Lessee shall reclaim all disturbed or affected portions of the property <br />in full compliance with all local, State or Federal rules or regulations, which <br />shall include, inter olio, not less than the following reclamation procedure. <br />(a) Contouring areas to conform with surrounding landscapes. <br />(b) Topsoil shall be stockpiled and placed on disturbed areas <br />to a depth of 9" minimum. <br />(c) Prior to reseeding 200 pounds of ammonia and 100 pounds of <br />super phosphate will be applied per acre and disced to a depth <br />of 4 inches. <br />(d) Reseeding and obtaining a reasonable stand of the following grasses; <br /> POUNDS P.L,S./ <br />SPECIES ACRE PERCENT <br />Western Wheatgrass (Rosanna) 2.0 16 <br />Slender Wheatgrass (Primary 2.0 16 <br />Intermediate Wheatgrass (Amur or Oahe) 1.5 12 <br />Crested Wheatgrass (Nordau) 0.5 4 <br />Mountain Brome (Manchar) 2.0 16 <br />Smooth Brome (Manchar) 0.5 4 <br />Green Needlegrass 0.5 4 <br />Big Bluegrass (Sherman) 2.0 16 <br />Canada Wildrye 1.0 8 <br />Yellow Sweetclover 0.5 4 <br /> 12.5 100 <br />In the event Lessor desires a different although similar <br />mixture in reseeding, it shall notify Lessee, who, after <br />obtaining necessary approval, shall thereafter reseed with <br />such approved mixture. <br />-3- <br />
